Strengthening legal risk prevention and control to protect major project construction

 

 

To enhance the ability to prevent and resolve legal risks in major projects and to protect the construction of major projects, on July 18, the Demonstration Zone Party Working Committee's theoretical study center group held a centralized study (expanded) meeting, inviting Fu Dongjie, a member of the Judicial Committee and director of the second civil court of Nantong Intermediate People's Court, to give a special lecture on "Strengthening Legal Risk Prevention and Control in Major Projects." Lu Zhonghua, secretary of the Demonstration Zone Party Working Committee, attended the study meeting, and Bao Xiaowang, member of the Party Working Committee, presided over the meeting.

 

This study session used "Interpretation of Several Legal Issues in Investment Attraction Contracts" as its starting point, focusing on the main characteristics, nature, judgment standards, and practical handling of investment attraction contracts; the main legal issues and judicial opinions in the contracts; and the review of key contract clauses. Combining the actual development of major projects in the demonstration zone, it proposed countermeasures and suggestions for preventing and resolving relevant legal risks in three aspects: risk prevention during the negotiation and contracting stage, selection of contract subjects and determination of contract content, and contract performance and dispute resolution.

 

The demonstration zone is in a period of rapid growth in major projects. In 2024, six projects in the demonstration zone were among the provincial key projects, a historical high. The attraction and service of major projects requires the investment promotion team to use the rule of law thinking, adhere to acting according to law and regulated investment promotion, and proactively prevent risks. Participants stated that through this study session, they have gained a deeper understanding of the importance of legal risk prevention and control in major projects. They will use this training as an opportunity to strengthen their legal awareness, improve risk avoidance work, and ensure the smooth and orderly progress of projects with practical actions.

Members of the Demonstration Zone Party Working Committee's theoretical study center group, the main leaders of the court, procuratorate, various bureaus (offices, centers, special teams), Sanyu Town, the First Office, various resident institutions, and the power supply service center, as well as the leading members of the Economic Development Bureau and the Investment Promotion Bureau, participated in the study session.
